Roger Bowler founded TurboHercules SAS to commercialize the Hercules technology. In 2009, TurboHercules SAS first asked IBM to license z/OS for use on TurboHercules systems. On November 4, 2009, in a letter to TurboHercules, IBM declined, citing its policy against licensing its software on systems that infringe its intellectual property (IP).

On November 18, TurboHercules requested a list of infringing IP. On March 11, 2010, IBM provided TurboHercules a "non-exhaustive list" of nearly 200 patents and patent applications. The list included numerous hardware patents but also two patents which IBM had previously pledged to the open source community.

TurboHercules SAS then filed a complaint with European Union regulators, alleging that IBM is engaging in anti-competitive practices, and also issued a press release criticizing IBM. However, IBM has neither taken any legal action, nor issued a cease and desist letter, and simply refuses to license z/OS.
